    • You may reschedule your class through the link on your booking conformation email.

    • You are limited to 3 free reschedule requests per registration as long as rescheduling is done 48 hours before your class start time.

      After your 3 free reschedule limit has been reached, a “Max Reschedule” fee will be added to your registration for each future reschedule request.

    • If you reschedule your class within 48 hours of your course start time, a “Late Reschedule” fee will be added to your registration. The fee must be paid before you will attend the rescheduled class. Each fee must be paid in order to be eligible to reschedule.

    • $30 "Late/Max Reschedule” fee for ACLS, ASLS, PALS and PEARS Classes. $15 "Late/Max Reschedule” fee for all other classes.

    • No refund or additional course credit will be given once a class has been scheduled using the course credit.

    • A “No Show” Fee will be added to your registration if you do not show up for your scheduled class (20 minutes grace period) and do not provide prior notice (at least 1 hour prior to class start time) that you won’t be attending. All fees must be paid before you are able to attend class or reschedule.

    • No refund for the "No Show". However, after the "No Show" fee, the course credit will be kept in the file for one calendar year.

      No another course credit will be given on that transaction once a class has been booked using the course credit.

    • $50 "No Show" fee for ACLS, ASLS, PALS and PEARS Classes. $25 "No Show" fee for all other classes.

    • You may cancel your class 14 days before the class date by sending us an email. You will receive refund for classroom based courses when cancellation is 14 days before your original course start time with a subject to a fee of 6% to cover the cost charged by the credit card processing company.

    • Classroom course cancellations after above timeframe will not receive refund, though course credit will be kept on file for 1 calendar year with “Late Cancellation Fee”

    • Payment of "Late Cancellation" fee(s) must be paid before you are able to (re)schedule and attend the class using the course credit.

      No refund or additional course credit will be given once a class has been scheduled using the course credit.

    • $30 "Late Cancellation" fee for ACLS, ASLS, PALS and PEARS Classes. $15 "Late Cancellation" fee for all other classes.

    • Online courses/ HeartCode courses/ Blended Learning courses are not eligible for refund once the online course is released.

    • For the blended learning class, if online course is released to you, you may reschedule your skill session class through the link in the booking email you received. Please go over "Reschedule your Class" policy.

    • You will receive refund when online course is not released yet and cancellation is done 14 days before your original course start time with a subject to a fee of 6% to cover the cost charged by the credit card processing company.

    • Course cancellation after above timeframe will not receive refund regardless the online course is released or not, though course credit will be kept on file for 1 calendar year with “Late Cancellation” fee.

    • Payment of "Late Cancellation" fee(s) must be paid before you are able to (re)schedule and attend the class using the course credit.

      No refund or additional course credit will be given on that transaction once a class has been scheduled using the course credit.

Policy and Procedures

In consideration of the services of Cali Academy LLC and their owners, officers, instructors, agents, promoters, participants, employees and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as “CAL”), I, (as well as all members of the household participating in the virtual seminar with me) hereby agree to release, indemnify, and discharge, CAL, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows:

  1. I acknowledge that my participation in some activities entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.

  2. I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks.

  3. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless CAL from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of any materials provided by CAL, including any such claims which allege negligent acts or omissions of CAL. I understand the hands-on course activities are meant for myself only, and I shall not allow any other member of my household (or anyone watching the virtual class through my IP address to participate in the activities), and I hereby release CAL from any such liability of such third parties.

  4. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.

  5. I understand that hands-on skills (or virtual event activities) to be experienced as part of requirement to successfully meet the associated certification that I am intended to hold, and I am fully responsible for all cost which are required to participate in the course activities. For the virtual classes CAL is not responsible for any computer failures, problems or errors, connection speed, interruptions of service or any technical or mechanical malfunctions, or any other malfunctions, whether caused by computer, servers, telephone, cable or satellites, human error, programming, equipment or otherwise related to the attempted entry into and participation during the class/workshop/meeting.

Caution: Any attempt to deliberately damage any website or link affiliated with this course, by myself or whoever accesses the class/workshop/meeting through my IP address, or otherwise undermine the legitimate operation of this activity is a violation of criminal and civil laws, and if such attempt should be made, CAL reserves the right, in its sole discretion, to disqualify and remove any individual from participation in this activity it finds to be tampering with the online operation of the course or to be acting in violation of these terms or in any unsportsmanlike, immoral, or disruptive manner, as well as seek damages or any other remedy available to it to the fullest extent permitted by law.

  1. In the event of any dispute, claim or cause of action arising from or connected with my attendance at this course, I agree to resolve any such dispute by binding arbitration pursuant to the terms hereof, and I further agree that the substantive law of the State of California shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect. The parties agree that the exclusive manner of resolving any and all disputes between them of any kind or nature whatsoever, including but not limited to disputes regarding validity, interpretation, enforcement or claimed breach of this Release, shall be by MANDATORY BINDING CONFIDENTIAL ARBITRATION, applying California law, and the arbitration will be heard and decided by one neutral arbitrator (“Arbitrator”) selected by mutual agreement. The parties have the right to conduct discovery in accordance with either California Code of Civil Procedure §1283.05 et seq. Whether a dispute is subject to Arbitration and issues regarding jurisdiction and enforceability of this Release shall be determined solely by the Arbitrator and not by any court. The Arbitrator may impose any and all legal and equitable remedies that would be available to any Party before any governmental dispute resolution forum or court of competent jurisdiction. Any papers required to be delivered or served in connection with Arbitration may be sent via email and certified mail. The Arbitrator shall issue a written opinion containing his/her factual and legal reasoning. BY AGREEING TO ARBITRATION, THE PARTIES ARE GIVING UP ANY RIGHTS THEY MAY HAVE TO A TRIAL BY JUDGE OR JURY REGARDING MATTERS REQUIRED TO BE ARBITRATED. THE PARTIES UNDERSTAND AND AGREE THAT THERE IS NO RIGHT TO AN APPEAL OR A REVIEW OF AN ARBITRATOR’S AWARD AS THERE WOULD BE OF A JUDGE OR JURY’S DECISION.

GENERAL RELEASE

In consideration of my participation in the course/activity presented by CAL and its vendors, I hereby generally release CAL and its owners, agents, representatives, employees, promoters, vendors, contractors, successors, assigns, insurers and affiliated companies for any and all liability whatsoever related to CAL’s negligence, negligent conduct or omissions, or my participation in this course/activity, including the hands-on skill session of the course. I execute this Release with the express intention of effecting the legal consequences provided by section 1542 of the California Civil Code, that is, the release of all liability associated with this course/activity. I hereby state that I have read and understand the following language of section 1542 of the California Civil Code:

“A general Release does not extend to claims which the creditor or releasing party does not know or suspect to exist in his or her favor at the time of execution of the release, which if known to him or her must have materially affected his or her settlement with the debtor or released party.”

Having been so apprised, I hereby elect to and do assume the risk for claims heretofore or hereafter arising, known or unknown, from this Release and from my participation in the course/activity. I acknowledge that I have been given the opportunity to ask questions regarding any aspect of the release contained herein, and by clicking below, do acknowledge that I have carefully and completely read and fully understand all aspects of the releases and agree to the terms in their entirety. By participation in or attending the virtual course, I, on behalf of myself and any and all other members of the household watching with me or through my IP address (collectively the Viewing Party”), expressly agree not to record by audio, video, photography or any other means, any portion of this course/activity, nor will the Viewing Party publish, post on the internet or otherwise make publicly available any recording of any portion of this course/activity. The Viewing Party hereby assigns, convey and transfer all right, title and interest including any copyright interest therein, in and to any recordings the Viewing Party might improperly make during this course/activity CAL and CAL shall be the sole and exclusive owner of any such recordings. The Viewing party also understands that all physical, written and/or electronic materials provided by CAL (whether via print, streaming, digital download or any other method) in connection with this course/activity are protected by the copyright laws, and the Viewing Party agrees not to use it in any form after this course/activity, other than for the Viewing Party’s personal use.

All video, audio, photographic and written material purchased by or provided to me during the course/activity is protected by the copyright laws of the United States and other countries. By participation in or attending the CAL’s course/activity, I expressly agree not to record by audio, video, photography or any other means (including without limitation any AI capture methods), any portion of this course/activity, nor will I publish, post on the internet or otherwise make publicly available any recording of any portion of this course/activity. I hereby assign, convey and transfer all right, title and interest including any copyright interest therein, in and to any AI capture or recordings I might improperly make during this course/activity to CAL and CAL shall be the sole and exclusive owner of any such AI capture or recordings. I also understand that all physical, written and/or electronic materials provided by CAL (whether via print, streaming, digital download or any other method) in connection with this course/activity are protected by the copyright laws, and I agree not to use it in any form after this course/activity, other than for my personal use.

I agree to hold CAL, CAL’s representatives, their owners, officers, instructors, employees, agents and contractors harmless from any liability which may occur from blurring, optical illusion, alteration, etc. or from any past, present, or future celebrity status.

PRIVACY AND DATA PROTECTION DISCLOSURE

I also understand that CAL Representatives will use the Personal Data they collect to follow up with me by mail, email, telephone, or other means to market to me additional CAL products and services, to invite me to other CAL programs and events, or to contact me for any other CAL marketing, personal development, educational, or other outreach opportunities CAL considers appropriate, in accordance with CAL’s Privacy Policy.

By signing this document or clicking the check button on the online registration form, I acknowledge that if anyone is hurt or property is damaged during my participation in these activities, I may be found by a court of law to have waived my right to maintain a lawsuit against CAL on the basis of any claims from which I have released them herein. I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.

 

PARENT’S OR GUARDIAN’S ADDITIONAL INDEMNIFICATION
